By providing an email address to TBY, the Clients consents to receiving email communications from TBY, including notices pursuant to the Terms and Conditions. The Clients also accepts the risk that email may not be a secure and confidential means of communication. TBY will not be liable for any loss or damage suffered as a result of communicating with a Clients by email.

  5. Clients must at all times observe the Studio guidelines, which may be notified to them from time to time, and are requested to comply with any reasonable directions, which TBY may issue to ensure the smooth operation of the Studio, for the convenience of all Members.

  6. Any marketing, educational or other materials of this nature whatsoever produced by TBY in connection with the Studio and which are made available to Clients at the Studio, will at all times remain the property of TBY and will be subject to the TBY’s copyright.

The Balanced Yoga {Raffy}  knows that you care how information about you is used and shared and we appreciate your trust in us to do that carefully and sensibly. This notice describes our privacy policy and forms part of our website terms and conditions (‘Website Terms’).

By accepting our Website Terms or by visiting (‘the Website’) you are accepting and consenting to the practices described in this Privacy Policy.

1.1.From you when you agree to take a service or product from us, in which case this may include your contact details, date of birth, how you will pay for the product or service and your bank details.
1.2.From you when you contact us with an enquiry or in response to a communication from us, in which case, this may tell us something about how you use our services.
1.3.From documents that are available to the public, such as the electoral register.
1.4 From your registration form when you first attend the studio.

We have strict security measures to protect Personal Data.
3.1.We work to protect the security of your information by not storing any credit card numbers, all online payment are done though appropriate credit card processing company.

General Terms and Conditions applicable to Use of a Web Site.


Neither party shall be liable to the other for any failure to perform any obligation under any Agreement which is due to an event beyond the control of such party including but not limited to any Act of God, terrorism, war, Political insurgence, insurrection, riot, civil unrest, act of civil or military authority, uprising, earthquake, flood or any other natural or man made eventuality outside of our control, which causes the termination of an agreement or contract entered into, nor which could have been reasonably foreseen.   1. Access to classes is subject to the purchase of a class pass or membership. Memberships renew automatically at the end of the of each billing cycle, currently every 4 weeks..

  2. Membership can be cancelled at any time and once your cancellation is processed you will be able to access the classes until the end of your current billing cycle. After this time access to classes will be revoked.


3.1 Details of class times at TBY may vary from time to time, including cancellations of individual classes. Class times will be published by the Studio and will be available on the website.
3.2 Class size is limited, therefore entry is on a first come, first served basis. Booking is strongly advised. 


  1. Subject to condition 2, when a person has completed a purchase (cash, bank transfer, scheduling link, this website) they become a client of TBY.

  2. Acceptance of a person as a client is at the absolute discretion of TBY.

  3. TBY reserves the right to expel from the Studio, suspend for a specific period or refuse to renew the membership of, any client whose conduct is or may, in TBY’s reasonable opinion, be injurious to the character of the Studio, or which amounts to a breach of the Terms and Conditions, or where such expulsion is otherwise in the interests of the other Members of the Studio. Any client so expelled will forthwith cease to be client of the Studio and will not be entitled to any refund for any period remaining of a membership, block bookings, packages or courses which is suspended or forfeited.


  1. Details of prices are available either on the website or directly from TBY and will be such prices as determined by TBY from time to time.

  2. A Client may not attend to any services, classes, course at/with TBY without first paying for the relevant service.

  3. Clients should arrive 5 minutes before classes. Once the class start, late arrivals will not be able to join the class. Any client not present at the beginning of the class will be considered absent/no-show and their place might be allocated to clients on the stand-by pool.

  4. Block bookings, appointments, courses and termly classes are as per published schedule. It is client's responsibility to take note of the schedule.

  5. Late arrival on appointment still has the same ending time agreed at time of booking, the appointment cannot be extended due to late arrival under any circumstances.

  6. Appointments late cancellations (less than 24hr notice) or no show will be charged in full.

  7. Payments for classes, block of classes, courses, workshops, gift certificates and any other services are non-refundable, non extendable, non exchangeable and non-transferable unless otherwise stated in the Terms and Conditions.


  1. TBY cannot be held responsible for any particular class, instructor and/or item of equipment not being available for whatever reason. TBY reserves the right to make alterations to the classes, instructors and/or equipment provided to clients, without notice and in its absolute discretion and TBY will not be liable for any loss occasioned by such alterations.

  2. It is the clients responsibility to ensure that they are capable of undergoing a routine of exercises or recommendations by any programme which they follow, or class which they attend. Clients accept the risk of injury from performing exercises and are advised to consult their doctor prior to beginning any class.

  3. TBY accepts no liability for loss or damage to property of clients or for injury to clients on the Studio premises or outside the Studio except insofar as such loss, damage or injury is by law incapable of exclusion.


  1. The provisions of this clause shall only apply to clients that purchase a series of Yoga classes, courses, term booking/pass and block bookings.

  2. Any client that is purchasing block bookings/termly pass/courses/series of classes cannot cancel once the block booking/course/termly class/series of classes has started therefore will not be entitled to any refund.

  3. Clients agree and acknowledge that by purchasing block bookings/termly pass/courses/series of classes, they are being given preferential rates by TBY and classes have been reserved therefore it is fair and reasonable that TBY will not refund any class the client misses due to personal reason, illnesses or unforeseen circumstances, no-show, late or absence.


  1. Clients are advised not to undertake strenuous physical activities without first seeking medical advice if they have concerns over their physical condition. TBY reserves the right to refuse access to any client if, in its absolute discretion, it considers that the health of the individual concerned may be endangered by the use of such facilities.

  2. Clients with low/high blood pressure and/or cardiac irregularities should not attend class until they have written permission from their doctor. By attending the class you agree you have such a permission from your doctor. If there is any doubt, the client should consult his doctor. Clients must notify the Studio of any circumstances affecting their health, which may be exacerbated through continued use of the Studio.

  3. Clients are required to follow the instructions of the instructor at all times.

  4. Clients are required to inform TBY, if they incur injuries or conditions, after the initial information stated on their registration form.


  1. A Client is entitled to use TBY Studio’s facilities (only those areas open to client use: halls, studio rooms, entrance to studio, toilets and access to enter the studio/hall), provided always that the Studio may at any time without notice withdraw all or part of its facilities for any period or periods and with notice, where practicable, in connection with any cleaning, repair, alteration or maintenance work, or for reasons beyond the control of TBY.

  2. Children under the age of 18 may only use the Studio and attend classes if accompanied by an adult.


  1. In the interests of safety and hygiene, no crockery or glass are permitted in the Studios. Only water is permitted in the Studios (no coloured drinks). No pets (with the exception of guide dogs), are permitted in the Studios building or grounds. Clients must not walk around the Studio barefoot if they have verrucas or similar foot complaints. Please wear socks, plaster or indoor flip-flops.

  2. Clients must use the main entrance to the Studio/Hall when entering or leaving the Studio/Hall.

  3. In the event of a fire, Clients are asked to make their way to the nearest available exit.

  4. Clients are required to use a suitable towel for the purpose of covering their yoga mat in the Studio. In the case the client uses studio mat instead of own mat/towel, it is reasonable for TBY to charge for the use of the Studio mats to cover for wear and tear and cleaning of the mats.

  5. Smoking is forbidden in the Studio and TBY premises which includes garden and drive. Your clothes must not smell of smoke or you might be asked to leave.

  6. In respect to other people that suffer from migraines and allergies, please refrain from using strong or synthetic perfumes/deodorants.


Personal belongings are brought onto the Studio/Hall premises at the Client’s own risk and TBY does not accept liability for any loss or damage whatsoever to such items.


Members are requested to wear a form of dress appropriate to the practice of Yoga, Thai Massage (fully dressed), consultation or any other services provided by TBY. We recommend that Clients wear stretch pants or shorts with an inner lining and a T-shirt or sports top or comfortable clothing considered suitable. Clients should attend classes and appointments barefoot (subject to clause 20.1). Footwear should be removed in the reception area, before entry to the Studio.

  • I understand that the Teacher/professional does not diagnose disease, illness, or prescribe any treatment or drugs, nor do they provide spinal manipulation. I understand that if I become uncomfortable for any reason that I may ask the Teacher/professional to end the session, and they will end the session (in a group event/class I will leave the event/class). I understand that the Teacher/professional may end the session for any inappropriate behaviour. I have stated all of the conditions that I am aware of, and this information is true and accurate. I will inform the Teacher/professional and TBY of any changes in my status.

    Consent for Therapy and Waiver of Liability:  

  • For children under 18: The person with Parental responsibility or guardianship for any children under the age of 18, agree to this disclaimer voluntarily and under no duress.

  • The undersigned (“Client”) hereby freely consents to receipt of massage services from: Raffaella Breare. Client agrees as follows: Client understands and agrees that they will provide the Teacher/professional with complete and accurate health information, and a written referral from Client’s primary healthcare provider if Client is currently receiving care or has a specific medical condition or symptoms for which Client takes medication or receives periodic evaluations or treatment. Client understands that yoga/therapy is designed to be an ancillary health aid and is not suitable for primary medical treatment for any condition. I will consult with a health professional for possible interaction with existing condition/medicines before making any purchase and committing to a class/therapy.

  • Client and Teacher/professional will take opportunity to discuss the potential benefits and possible side effects of yoga/therapy and agree upon a course of focused attention and therapy for the predetermined goals of stress reduction, relief of muscular discomfort, and/or promotion of general health. Client will take opportunity to ask questions of the Teacher/professional and has received all requested information.

  • Thai Massage: Client understands that the clothed body will remain clothed at all times for warmth, sense of security, and as a mark of massage therapy professionalism. Client agrees to immediately inform the Teacher/professional of any unusual sensation or discomfort so that the application of pressure during a massage may be adjusted to Client’s level of comfort. Client understands that Thai Yoga massage is not sexual in any manner and that any illicit or suggestive remarks or behaviour on the client’s part will result in an immediate termination of the therapy session. Client understands that if the session is terminated for such reason, payment will be expected in full; regardless if the massage is completed or not.

    Client hereby assumes full responsibility for receipt of the therapy/classes/courses delivered in person/internet/ online/telephone, and releases and discharges Teacher/professional from any and all claims, liabilities, damages, actions, or causes of action arising from the therapy received hereunder, including, without limitation, any damages arising from acts of active or passive negligence on the part of the Teacher/professional, to the fullest extent allowed by law.

    Client, in booking a service with TBY, consent for yoga/Therapy and Waiver of Liability (“Consent”), understands and agrees that this Consent will apply to and govern the current and all future yoga/therapy sessions booked with TBY performed by  the Teacher/professional giving the yoga/therapy.

  • Booking and participating to service and therapy offered by The Balanced Yoga (TBY) is proof of your intention to execute a complete and unconditional waiver & release of all liability to the full extent of the law and that you are 18 years of age or older and mentally competent to enter into this waiver.

  • You understand that yoga/therapies includes physical movements as well as an opportunity for relaxation, stress reduction and relief of muscular tension.

  • I ( adult or guardian/parent) hereby agree to the following:

    1) That I am participating in the Yoga classes, therapies, private consultation or any other exercise programs, videos, books, e-books or handouts offered by TBY during which I will receive information and instruction about Yoga, Ayurveda, Sound Healing, Energy healing/Reiki, physical exercise or health. I recognise that excercise requires physical exertion, which may be strenuous and may cause physical injury, and I am fully aware of the risks and hazards involved.

    2) I understand that it is my responsibility to consult a physician/health professional prior to and regarding my participation in the Yoga classes, Yoga consultation, Ayurveda/Therapies consultation, health programs or workshops offered by Teacher/professional . I represent and warrant that I am physically fit and I have no medical condition, which would prevent my full participation in this classes, therapies, health programmes or workshops offered by TBY. I understand that Yoga, Ayurveda and other therapies are not a substitute for medical attention, examination, diagnosis or treatment and I will consult a medical professional for that purpose; yoga, ayurveda and therapies is not recommended and is not safe under certain medical conditions.

    3) If I am pregnant I understand that I participate fully at my own risk and that of my unborn child/children.

    4) In consideration of being permitted to participate in yoga/ayurveda/therapies, health programmes or workshops, I agree to assume full responsibility for any risks, injuries , damage or liability, known or unknown, which I might incur as a result of participating in the programmes offered by my Teacher/professional , The Balanced Yoga or substitute teacher.

    5) I understand that from time to time during yoga/therapies, the Teacher/professional may physically adjust students’ form and posture. If I do not want such physical adjustments, I will so inform the Teacher/professional  each time I attend. I also acknowledge that if I do wish to receive such adjustments, it is my responsibility to inform the Teacher/professional when an adjustment has gone as far as I desire at that time.

    6) I give permission to TBY to take photograph/images of me/my child/children during the classes, events and workshops for promotional uses. I will be verbally informed when this take place so that I can choose not to participate.  TBY has the right to reproduce, use, exhibit, display, broadcast and distribute or create derivative works of these images and recordings in any media now known or later developed. I acknowledge that TBY own the rights to the images. I also waive any right to royalties or any other compensation arising from the use of images and recordings.

    7) I specifically agree to indemnify and hold harmless the Teacher/professional,  Raffaella Breare and The Balanced Yoga as to any loss, cost, claim, injury, damage or liability, sustained or incurred by participating in the classes, or through my use of the facilities or equipment of TBY which is caused by an act or omission, whether negligent, intentional or otherwise, of an employee, representative, or agent of TBY. I, my heirs, or legal representative forever release waive, discharge and covenant not to sue Raffaella Breare and The Balanced Yoga for any injury or death caused by my participation in the yoga class.  By completing a booking (Cash, cheque and any  form of electronic payment/money transfer) it constitutes my full acceptance of this waiver. I have read the release and waiver of liability and fully understand its consent. When I complete a booking, I voluntarily agree to the disclaimer, terms and conditions stated above.
